These Terms of Service ("Terms") govern your use of the Action Committee for Eldorado ("ACE") website and application system for submitting and reviewing fixed hardware applications for climbing routes in Eldorado Canyon State Park. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, submitting an application, or participating in the review process, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.

If you do not agree with these Terms, you may not use our services.

2. Use of Service

2.1 Eligibility

You must be at least 18 years old to submit applications or vote on proposed changes. Users under 18 may view public information with parental consent.

3. Application Process

3.1 Application Submissions

All applications for new routes, route modifications, or hardware changes must be submitted through the official ACE application system. By submitting an application, you certify that:

• All information provided is accurate to the best of your knowledge
• You have personally assessed the route or area in question
• You understand that approval does not guarantee permission from Colorado State Parks
• You will comply with all park regulations and climbing ethics

3.2 Review Timeline

ACE strives to review applications in a timely manner, but does not guarantee any specific timeline. Applications requiring public review may take several months to process.

4. Intellectual Property

4.1 User Content

By submitting content (including applications, topos, photos, and comments), you grant ACE a non-exclusive, royalty-free, perpetual license to use, display, and distribute such content for purposes related to climbing access and conservation.

4.2 Copyright

You represent that you own or have the right to submit all content you provide. You may not submit copyrighted material without permission from the owner.

5. Privacy

Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of your information as described in the Privacy Policy.

Application information, including applicant names and route details, may be made public as part of the review process.

6. Disclaimers and Limitations

6.1 No Warranty

The service is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

6.2 Limitation of Liability

In no event shall ACE, its directors, officers, volunteers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

7. Indemnification

You agree to indemnify and hold harmless ACE, its officers, directors, volunteers, and agents from any claims, damages, losses, or expenses (including attorney's fees) arising from your use of the service, violation of these Terms, or climbing activities related to submitted applications.

8. Modifications to Terms

ACE reserves the right to modify these Terms at any time. We will notify users of material changes via email or website notice. Continued use of the service after modifications constitutes acceptance of the updated Terms.

9. Termination

ACE may terminate or suspend your account at any time for violation of these Terms or for any other reason at our sole discretion. You may terminate your account at any time in the user settings or by contacting us directly via email.

If your account is terminated, you may not create a new account without our permission. If you believe your account was terminated in error, you may request to have it reinstated by contacting us directly via email.
